The Bamboo Premium  Financing Inc. Portal via My Express Tool (the “Bamboo Portal”) allows you to immediately access your premium financing documents, change certain information you have provided to us and arrange a payment if you have missed a regularly scheduled payment.

Please read the following terms and conditions carefully.  If you do not agree with these terms and conditions, you should not use the Bamboo Portal.  The terms “us”, “we” and “our” refer to Bamboo Premium  Financing Inc, which hosts the Bamboo Portal.  The terms “you” and “yours” refers to the registered user or viewer of the Bamboo Portal. 

Terms and Conditions

The Bamboo Portal is provided by us for your benefit. By voluntarily accessing the Bamboo Portal, you agree to abide by the following terms and conditions of use. We may suspend your user privileges and block your access to the Bamboo Portal if you violate these Terms and Conditions. We may modify or amend these terms and conditions at any time.

 

Access

You will be granted a user link to access the Bamboo Portal.  Your access link is for your personal use only, and you must not permit anyone else to use your access link, or transfer your access link to anyone else. If you believe that someone else has gained access to your access link, you must notify us immediately.

 

Viewing and Downloading Documents

You may view and download documents from the Bamboo Portal, including your premium finance agreement, payment schedule and loan balance.

 

Electronic Signature

Upon registration, you will select an email address which constitutes your electronic signature ("Electronic Signature") when you use the Bamboo Portal. You acknowledge and agree that your Electronic Signature is the legal equivalent to your written, signed instructions and you authorize us to execute any instructions which are provided by your Electronic Signature. When you click "accept",  "submit"  or other similar buttons on the Bamboo Portal, except as otherwise specifically indicated, these carry the same legal effect as if you had signed and delivered paper versions of the documents to us.

We will not be required to verify the actual identity or authority of any user of your Electronic Signature. You agree to be liable and hold us harmless for any loss caused as a result of or in connection with: (i) any authorized use of your Electronic Signature, and (ii) any unauthorized use of your Electronic Signature that results from your failure to protect the confidentiality of your Electronic Signature, including but not limited to any transaction performed, or information obtained through such use.

 

Security

The Bamboo Portal uses industry standard security protection to protect against unauthorized access, including firewall protection. We may change or enhance the security protection without notice to you. You agree to comply with all security requirements established by us from time to time in connection with the use of the Bamboo Portal and not to disable or bypass any security features. Unauthorized attempts to circumvent security features, to use the Bamboo Portal for purposes other than its intended purposes or to obtain, alter, damage or destroy information or otherwise interfere with the operation of the Bamboo Portal are not permitted.

You recognize that using the Bamboo Portal is not without risk as no completely secure system exists for the electronic transmission and storage of confidential information.

 

Termination of Bamboo Portal

We may discontinue the Bamboo Portal at any time. If we decide to no longer provide the Bamboo Portal, we will notify you in advance of such termination.

 

Disclaimer of Warranties

Access to the Bamboo Portal and its content, products and services are provided “as is”. We do not make any warranties or representations, expressed or implied, concerning the merchantability, quality, non-infringement or fitness for a particular purpose of the Bamboo Portal or its content. You assume all risk of use. No warranty is given that access to the Bamboo portal will be error-free, free of viruses or uninterrupted. We are not responsible for invalid destinations and transmission errors in, corruption of, or the security of information carried over telecommunications carriers’ or other providers’ facilities. We have no liability for faulty or interrupted communication links.

 

Limitation of Liability

We shall not be liable to you or any third party for any direct, special, indirect, consequential or incidental damages incurred arising out of the use or the inability to use the Bamboo Portal, even if we have been advised of the possibility of such damage or loss.

Choice of Law / Jurisdiction

These terms and conditions shall be construed according to the Laws of the Province of Alberta.

In the event that any legal proceedings are commenced in any court with respect to any matter arising under these terms and conditions, the parties hereto specifically consent and agree that the courts of Alberta shall have jurisdiction over each of the parties hereto and over the subject matter of any such proceedings, and the venue of any such action shall be in Calgary.
